FAQ

Hiring an attorney who is a former USCIS Asylum Officer provides a unique strategic advantage. This insider experience allows our firm to anticipate how asylum officers review your asylum application (Form I-589), prepare you specifically for intense interview questioning, avoid common red flags, and structure your personal declaration to meet federal legal standards.

What is the one-year filing deadline for asylum, and are there exceptions? Generally, you must apply for asylum within one year of arriving in the United States. However, exceptions exist for changed circumstances affecting your eligibility or extraordinary circumstances that caused the delay. An immigration attorney can help you determine whether an exception may apply to your case.

To qualify for asylum in the U.S., you must generally demonstrate that:

  • You are unable or unwilling to return to your home country due to past persecution or a well-founded fear of future persecution.
  • The persecution is directly based on one of five protected grounds: race, religion, nationality, political opinion, or membership in a particular social group.
  • The persecution is inflicted by the government or a group/individual that the government is unable or unwilling to control.
  • You apply for asylum within one year of your last entry into the U.S. (unless an exception applies).

Under U.S. immigration law, you must file Form I-589 (Application for Asylum and for Withholding of Removal) within one year of arriving in the U.S. However, if you missed the deadline, you may still be eligible to apply under specific exceptions:

  • Changed Circumstances: Some examples could be major political shifts in your home country, changes in U.S. law, or changes in your personal circumstances.
  • Extraordinary Circumstances: Such things as severe illness, physical/mental incapacity, ineffective assistance of prior counsel, or maintaining lawful immigration status until recently.

The timeline for asylum cases varies depending on whether your application is affirmative (through USCIS) or defensive (in Immigration Court):

  • Affirmative Asylum (USCIS): Can take anywhere from a few months to several years due to agency backlogs and priority scheduling.
  • Defensive Asylum (EOIR / Immigration Court): Typically takes 1 to 3+ years to reach an Individual (Merits) Hearing.

Despite processing delays, filing a complete and legally sound application ensures you remain eligible to apply for a Work Authorization Document (EAD) while your case is pending.

Is it necessary that my fiancé(e) and I have met in person? Yes, you and your fiancé(e) must have met in person in the two years preceding the application. There are some limited exceptions. An immigration attorney can help ensure the petition and supporting evidence meet USCIS requirements.

You can file Form I-765 for an Employment Authorization Document (EAD) 150 days after filing your complete asylum application (Form I-589) to USCIS or the Immigration Court. There are no initial filing fees for an initial asylum-based work permit (Category C8). The employment authorization document cannot be issued until 180 days has passed since you filed your asylum application.

  • Affirmative Asylum: For individuals who are not in deportation or removal proceedings. You submit your application directly to USCIS and attend a non-adversarial interview with an Asylum Officer.
  • Defensive Asylum: For individuals who are currently in removal proceedings before an Immigration Judge (e.g., after being detained at the border or referred to court by USCIS). This is a formal court proceeding where an ICE trial attorney cross-examines your claim and a judge will issue a decision.

Yes. You can include your legally married spouse and any unmarried children who are under 21 years old on your Form I-589 at the time of filing, provided they are physically present in the United States. If granted asylum, they will receive derivative asylum status alongside you.

During an affirmative asylum interview, an Asylum Officer questions you in detail regarding your background, your personal declaration, your journey to the U.S., and the specific persecution you faced or fear. The officer evaluates your credibility and checks if your testimony aligns with country conditions and everything you submitted. Having an attorney present ensures your rights are protected and that all legal issues are properly addressed before the interview concludes.
